This past Friday, a New Jersey man was crushed by a concrete partition wall or barrier while at work at an industrial plant. The accident occurred at a recycling center in Camden. According to at least one online news report*, the accident occurred after a front-end loader knocked over a concrete wall which then fell onto the worker. A forklift driver attempted to free the worker from the concrete slab. Work related deaths are senseless tragedies. Families of those left behind suffer terribly by the loss of a loved one – a father, mother, sibling, friend, etc. The emotional toll is significant, but when coupled with the loss of the workers’ income, the loss is unbearable. For example, adequate training is crucial. Many companies fail to provide proper operator training in accordance with OSHA operator training standards. When a company fails to take these simple actions, it may be liable. In addition, other parties such as a subcontractor which operated the front-end loader or an equipment rental or maintenance company which serviced the front-end loader may be liable.
