What is a negligent hiring claim against a school in a sex abuse case?

Negligent hiring claims are very common in school sex abuse situations. They are based on the following types of actions or inactions:

  • failing to conduct background checks,
  • negligence in conducting a background check, and
  • failing to follow up on a reference.

In many cases, whether it is a school, day care facility or other child/youth organization, the hiring employee makes a mistake. For instance, a background check may be performed on the wrong individual or a full background check was not performed at all.  For example, a day care school which hires a maintenance worker who has a history of being fired for inappropriate conduct may be liable when the worker abuses a child; the worker was hired due to a failure to follow up on the worker’s references. This type of situation usually occurs when a worker is hired because that person is a family member, friend, neighbor, etc. Rather than take the appropriate steps and conduct a full background check, the hiring process is relaxed.

Whether it’s by a teacher, coach, school nurse or school administrator such as a principal, school sex abuse claims must be examined carefully to identify other potential claims.
