Pennsylvania Bar & Restaurant Liability for Serving Minors Alcohol

Maryland Supreme Court Hears Arguments to 2023 Child Victims Act

Earlier this year, three young men were killed in Indiana County, Pennsylvania after their car overturned in a pond. All three men were under the age of 21, and according to the Pennsylvania State Police Bureau of Liquor Control, all three had been served alcohol at a sports bar in Cowanshannock, PA.

As a result of that investigation, new charges were filed against the bar. The new charges relate to two underage young women who were allegedly served shots of alcohol and beer the same night the three young men were at the bar.

The bar owner is also charged with tampering with security videotape recordings which showed the three men at the bar. As a result of this very serious case, the PA Bureau of Liquor Control Enforcement is going to step up enforcement of underage drinking laws at bars and restaurants. *Source: http://triblive.comCowanshannock bar accused of serving 3 men before fatal accident hit with new charges

Duties of Bars and Restaurants Which Serve Alcohol in Pennsylvania

Bars and restaurants in Pennsylvania which serve alcohol do so only by license. The state of Pennsylvania can suspend or revoke a license if it is determined that a bar served a minor or served alcohol to someone who was visibly intoxicated.

In addition, the bar can face civil liability for injuries caused by intoxicated customers. The most common example is a DUI or DWI accident. A bar or restaurant can be held liable and be required to pay civil damages when a drunk customer gets behind the wheel and causes a car accident. Other types of situations in which a bar or restaurant can face liability include bar fights and accidental mishaps (i.e., drunk customer falls into a ditch and suffers injury or dies).

The key in these kinds of cases is prompt investigation. Learn more about investigation in a bar and restaurant liability case involving alcohol.
