The Legal Intelligencer’s P.J. D’Annuzio reported on Laffey Bucci D’Andrea Reich & Ryan’s recent victory in their case against Valley Forge Military Academy.
The case was improperly transferred out of state court after the Defendants used a tactic called “snap removal.” U.S. District Judge Michael Baylson of the Eastern District of Pennsylvania granted the Plaintiff’s request to remand the case to the Philadelphia Court of Common Pleas.
The plaintiff is represented by attorneys Guy D’Andrea, and Stewart Ryan.
Attorney Stewart Ryan said, “While we disagree with the tactic used by the Defendant in attempting a snap removal to avoid this case being heard by a Philadelphia County jury in a matter involving solely state law claims against an in-state defendant, especially given the allegations of abuse in this case, we are pleased with Judge Baylson’s decision to apply the law and require the Defendant to strictly adhere to the requirements regarding removal.”
