Can a bystander bring a products liability case?

A: In Pennsylvania and New Jersey, bystanders who are injured in a defective product accident are eligible to bring products liability actions against product manufacturers. The plaintiff in a products liability action is not required to have purchased the product. Bystanders may be able to receive financial compensation for their pain and suffering, medical bills and time lost from work.

A common example involves a nail gun misfire accident in which a bystander is injured. A co-worker who is standing nearby when a defective nail gun misfires and sustains injury would be able to file a defective products liability action.

However, it is important to speak to a defective tool lawyer immediately. Each case varies and other issues like the statute of limitations must be reviewed carefully.
